President Biden signed H.R. 82, the Social Security Fairness Act of 2023, into law during a White House ceremony on Sunday, January 5, 2025.
The Social Security Fairness Act fully repeals the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO), which have historically reduced or eliminated Social Security benefits for teachers and other public employees in Massachusetts.

The Social Security Administration (SSA), which is responsible for implementing the repeal of the WEP and GPO, has issued initial guidance and is evaluating how to implement the new law.
