Legislation extends waiver of earnings and hours restrictions for most retired public employees through 2021.

In April, Chapter 53 of the Acts of 2020 waived earnings and hours restrictions for many retired public employees working in the public sector for calendar year 2020, during the Governor’s State of Emergency, which began on March 10, 2020.

On December 11, 2020, Chapter 227 of the Acts of 2020 (Note: The final FY2021 is not yet available online; please see PERAC Memo #35 for reference, linked below) extended the waiver period through the duration of the Governor’s State of Emergency, or the end of calendar year 2021, whichever occurs first.

It is important to remember that restrictions are waived regardless of whether the individual is involved in COVID-19 related work. The waiver does not apply to disability retirees; their restrictions remain intact.

As a reminder, adherence to post-retirement restrictions is the statutory responsibility of the employer and employee. Please review the following PERAC Memos:
